1. INTRODUCTION

 

General conditions can be updated or modified at any time by www.gomitoli.com / www.yarnovertuscany.com, which will communicate any change on website pages. Following conditions regard purchase of products through internet.

 

2. DEFINITIONS

 

Customer: User registered to www.gomitoli.com / www.yarnovertuscany.com

Trader: Effe Elle srl – Piazza Oglio 49 - 59013 Montemurlo PO

 

3. ORDERS/CONTRACT

 

Orders are accepted via Internet. In case of any error, Customer must immediately advise writing an email to gomitoli.com@gmail.com soon after Order Confirmation, otherwise indications written on Order Confirmation will be applied to contract.

Effe Elle srl reserves the right to accept or refuse an order, and to deliver it as scheduled, advising the Customer.

 

4. OBLIGATIONS OF PURCHASER

 

- Purchaser must accept, print and keep general conditions, once purchasing procedures is completed.

- It is forbidden to insert false/invented data: personal data and email must be real one's own.

- www.gomitoli.com / www.yarnovertuscany.com is not responsible for wrong data provided by Customer, who is the only responsible for correct data entry.

5. PRICES

 

All prices on www.gomitoli.com / www.yarnovertuscany.com are in Euro, IVA (VAT) included.

Minimum orders is 20,00 Euro, plus shipping expenses as indicated on order confirmation form.

 

6. PAYMENT METHOD

 

You can choose of of the following methods:

- IW SMILE accepting all credit cards (Effe Elle can ask for a copy of document of credit card holder).

 

- Anticipate wire transfer: transmission time to bank: 24/48 hours. You will find bank info once this payment method is selected.

 

- Cash on delivery (for Italy only): additional cost of 6,00 Euro.

 

In caso di pagamento con Carta di Credito, Effe Elle srl si riserva la possibilità di richiedere copia del documento di identità dell'intestatario.

 

7. SHIPPING

 

Orders will be shipped through SDA in Italy, or through other courier for other countries, directly to shipping to address listed on online order copy.

Effe Elle srl will deliver merchandise 3-5 working days after receipt of payment. In case one or more item are not available, customer will be immediately advise, and delivery could be delayed accordingly.

8. PURCHASE WITHDRAWAL

 

According to Italian D. L. 22/05/1999, n. 185, Customer can recede from the purchse, within 10 days from receipt of merchandise, through registered letter addressed to Effe Elle srl Piazza Oglio 49 59013 Montemurlo PO

In order to be reimbursed, Customer must ship merchandise at his/her expenses, together with delivery note/pkg list received at the delivery.

Products must be resent integral, in their packaging.

In case above conditions are not respected, products wil be resent to customer at carriage forward.

 

Gomitoli.com will reimburse through wire transfer within 30 days from receipt of merchandise.

As per D.L. nr. 50 of January 15 1992 Articolo 3 Secondo Comma, reimbursment are due only for amounts over 25,00 Euro NET.

As per D.L. 185 del 22/5/99 art. 5 comma 3, all products used by customer and products sold as special offers are not to be reimbursed.

Shipping expenses won't be reimbursed in any case.

 

9. CONTRACT WITHDRAWAL

 

- Gomitoli.com can rescind the contract by communicating it to Customer and giving an explanation. In that case, Customer will be refund for any possible amount already paid.

- Obligations accepted by customer (please refer to chapter “Obligations of Purchaser”) and payment are essential. Non-fulfilment of such conditions will determine the Contract Withdrawal as per Italian law art.1456 c.c., without passing judgment, except for the right of www.gomitoli.com / www.yarnovertuscany.com to convene to recoup any loss suffered.

 

10. PLACE OF JURISDICTION

 

For any controversy, the place of jurisdiction will be Pistoia (Italy).
